Generative AI's Legal Risks for the Jewellery Industry
A recent special report, prepared by the CIBJO Ethics Commission, sheds light on the complex legal and ethical implications of Generative Artificial Intelligence (GenAI) within the jewelry industry. This crucial document emphasizes the difficulties existing intellectual property laws face in adapting to the rapid advancements of AI technology, particularly as GenAI becomes more prevalent in creating new designs, models, and customizations. The report calls for proactive measures from companies to establish clear internal guidelines to ensure responsible use of this evolving technology.
As the CIBJO Congress in Vicenza, Italy, approaches, the sixth pre-congress special report has been unveiled, spearheaded by Sara Yood, head of the CIBJO Ethics Commission. This comprehensive analysis dives into the ethical and legal complexities that Generative AI presents to the global jewelry sector. GenAI, a specialized branch of artificial intelligence, is capable of generating novel content such as jewelry designs, computer-aided design (CAD) models, realistic renderings, and personalized modifications.
Ms. Yood distinguishes between AI-assisted work, where human input guides creative choices, and AI-generated work, where the system largely determines the artistic output. A key concern highlighted in the report is that the ethical application of GenAI should never infringe upon the intellectual property rights of designers and skilled artisans. However, the report acknowledges that current intellectual property legislation is struggling to keep pace with the swift development of AI technologies.
The report underscores that GenAI largely operates without stringent regulation, leading to a lack of oversight regarding algorithm development, data sourcing, and the prevention of copyrighted material being used for training AI models. In the absence of clear regulatory frameworks, the onus falls on individual companies to develop their own comprehensive guidelines. These guidelines are crucial for ensuring that employees avoid intentionally or inadvertently using copyrighted, patented, or trademarked content belonging to others. Establishing such a governance framework for acceptable AI usage will also position businesses to continuously assess new GenAI systems as they emerge in the market.
Ultimately, the report concludes that the acceptance and legitimacy of Generative AI within the jewelry industry will hinge on its ability to amplify human creativity, maintain cultural relevance, and foster the trust that underpins the inherent value of jewelry, rather than undermining these fundamental aspects. This necessitates a careful balance between technological innovation and the protection of artistic integrity and ethical standards.
